My understanding is Save Mart has the right to use the Lucky name "in their markets."

Whatever that means. Does that mean only former Albertsons markets, or does that mean original Save Mart markets too?

Of course that whole deal was written up at a time when Albertsons LLC did not appear to be in the grocery business long term.

There are a couple places where the Lucky name was put onto former Albertsons stores by Save Mart that were never Lucky before, and never even had a Lucky Store. Ukiah, CA is the biggest outlier that fits that definition.

The Grocery Outlet suit began shortly before the break-up of Albertsons Inc. officially and was officially concluded in the courts over a year after Albertsons LLC sold off NorCal. Albertsons continued to fight (through LLC from what court documents indicate, seeing how LLC was the restructured Albertsons Inc.) it through licensing the rights in NorCal. It sure would be nice to see what exactly it entailed, if it had a non-compete clause it expired in less than a decade, and surely there must be some sort of escape clause to buy back the name at a cost...though if Albertsons bought Save Mart entirely (perish the thought), they would almost certainly have to do some divesting.

Interesting thought. There is a lot of overlap between Albertsons and Save Mart. But given the number of poorly performing stores Save Mart has (especially where they compete against Safeway), it could actually work out. The best Save Marts are the ones that don't compete against Safeway. They do have stores in quite a few towns with no or limited Safeway presence in the central valley and even rural NorCal.
